Stamp Duty on Property in Gujarat — Rates, Jantri & Adjudication

Stamp duty is a tax payable on property and legal documents, and paying the correct amount is essential for a valid, dispute-free transaction. This guide explains how stamp duty on property in Gujarat is calculated using the Jantri rate, the registration charges, e-stamping, adjudication, and the penalties for under-stamping.

How is Stamp Duty Calculated in Gujarat?

Stamp duty on a sale deed and similar instruments is calculated on the higher of the consideration (transaction value) or the Jantri (ready reckoner) value fixed by the government for that area. A registration fee is charged in addition to the stamp duty. Because rates and rebates (for example, for female buyers) change from time to time, it is best to confirm the exact rate before execution.

What is the Jantri Rate?

The Jantri is the government-notified minimum value of land and property in a particular area. Stamp duty cannot be paid on a value lower than the Jantri value, even if the actual transaction price is lower. Knowing the correct Jantri rate for your property is essential to calculate the right stamp duty.

Under-stamping is risky: If a document is found to be insufficiently stamped, it can attract penalties and may be impounded. Always pay the correct stamp duty.

E-Stamping & Payment

Stamp duty in Gujarat is paid electronically through the e-stamping / Garvi system. The e-stamp certificate is then used at the time of registration before the Sub-Registrar.

Adjudication of Stamp Duty

Where there is doubt about the correct stamp duty payable on a document, you can apply to the Collector of Stamps for adjudication. The authority determines the proper duty, which protects the document from future objections. Adjudication is also relevant for older or under-stamped documents.
